GENERAL TERMS
The following words shall, unless otherwise stated or inconsistent with the context in which they appear, bear the following meanings and other words derived from the same origins as such words (that is, cognate words) shall bear corresponding meanings:
· "Arrangement(s)" means travel (subject to availability) on any departure date falling between the Start Date and End Date;
· "Booking(s)" means any booking(s) of arrangements made or to be made by the Passenger with the Company under these terms and conditions;
· "Company" shall be Waterways & Beyond, LLC, operating the luxury yacht Grand Victoria;
· "Agreement" shall mean these General Terms and Conditions;
· "Customer" means the person(s) or any of them who purchase any arrangement(s) or on whose behalf any Arrangement(s) is/are purchased;

2. CONTRACT
A contract exists between said customer (hereinafter “the Customer”) and the Company once the non-refundable deposit is confirmed. Under this contract, the Passenger they have received, understands, and agrees to the Terms and Conditions.
3. RATES
The rates are in US Dollars for a six-night cruise.
Included: Accommodation with en-suite bathrooms, all meals, selected regional wines and alcoholic beverages carried on board, all sightseeing tours and admittance fees as stipulated on our website, use of the vessel's bicycles and other facilities, and round-trip transfers from a single specified meeting point in Geneva.
Not Included: Air transportation, airport taxes, visas, health or accident insurance, trip cancellation insurance, optional activities not included in the itinerary, 7-10% crew gratuity, and purchases.
4. DEPOSIT AND FINAL PAYMENT
The Company will “hold” a Charter or Cabin Booking date on option for up to 14 days pending receipt of the required non-refundable deposit. If the deposit is not received within 14 days, the option may be released without further notice.
4.1 A non-refundable deposit equal to 20% of the total fare is due at the time of reservation.
4.2 The remaining balance of the total fare is due no later than 60 days prior to the departure date.
4.3 Payments can be made via wire transfer, credit card, or check.
4.4 All payments are processed in compliance with the Florida Seller of Travel Act (Fla. Stat. § 559.927 et seq.), and Waterways & Beyond LLC is a registered Seller of Travel in the State of Florida (Registration No. ST40102).
5. CANCELLATIONS AND REFUNDS
All payments made to the Company are non-refundable. By confirming the booking, the Agent and Passenger acknowledge and agree to this cancellation policy.
Because the Company incurs substantial costs in preparation for each voyage and operates on a fixed-schedule charter basis, refunds are not available for cancellations by the Passenger for any reason, including but not limited to illness, travel disruptions, personal emergencies, or dissatisfaction.
The Company strongly recommends the purchase of comprehensive travel insurance, including coverage for trip cancellation, interruption, and medical emergencies.
In the event that the Company must cancel a voyage due to force majeure or circumstances beyond its control (see Section 11), Passengers may be offered an alternative date or credit, at the Company’s sole discretion.
Nothing in this policy limits rights afforded under applicable Florida or federal law.
6. NON-SMOKING POLICY
A strict non-smoking policy applies in the accommodation area of the vessel. Those passengers who wish to smoke must do so outdoors on the deck areas.
7. SPECIAL DIETS
Please notify the Company of any dietary requirements. Every effort to accommodate the request will be made.
8. CHILDREN
Children are welcome on full charter cruises.
9. PETS
The Company operates with a small (hypoallergenic) Lhasa Apso on board as the Captain’s pet. He is a Certified Trained Service Dog. Passengers with dog-related allergies should declare this on the Booking Form. The Company cannot accept liability for any reactions resulting from undeclared allergies.
10. TRAVEL INSURANCE
The Company requires that all passengers carry adequate travel insurance covering trip cancellation, interruption, medical emergencies, and repatriation.
11. LIMITS OF RESPONSIBILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, WATERWAYS & BEYOND LLC (“THE COMPANY”) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF ENJOYMENT, LOSS OF TIME, EMOTIONAL DISTRESS, OR LOSS OF REVENUE.
The Passenger acknowledges and agrees that:
a) The Company is not liable for any personal injury, death, property damage, or loss arising from or related to theft, vandalism, fire, weather conditions, accidents, illness, pandemics, Acts of God, or the actions or omissions (whether negligent or intentional) of any third party not under the direct control of the Company.
b) The Company is not responsible for events beyond its control, including but not limited to force majeure events such as strikes, civil unrest, canal closures, vessel damage, mechanical failure, labor disputes, government actions, terrorism, or war.
c) Passengers assume full responsibility for their own conduct and personal belongings, and they are advised to obtain adequate travel and personal property insurance.
d) Passengers waive any and all claims against the Company for any such incidents, except to the extent caused by the Company’s own gross negligence or willful misconduct, which cannot be waived under applicable law.
e) This limitation of liability is a material term of this Agreement and is intended to allocate risk between the parties.
Nothing in this Section shall be interpreted to waive or limit any rights protected under applicable state or federal law that cannot legally be waived.
12. CRUISE ROUTES
Routes and vessel alterations and substitutions: All routes are subject to change without notice. Some waterways may be subject to occasional closures due to drought, storms, floods, canal or lock repairs, or other unforeseen circumstances that result in conditions unsafe for navigation.
a) If navigation must be suspended, passengers will continue to be accommodated on the stationary vessel and the planned excursions will continue.
b) The Company reserves the right to reverse a cruise route or cruise another waterway.
13. LAW AND JURISDICTION
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
The parties agree that the exclusive venue for any and all disputes, claims, or legal proceedings arising out of or relating to this Agreement, the services provided, or the relationship between the parties shall be Pasco County, Florida, and both parties hereby submit to the personal jurisdiction of the courts located therein.
The Passenger expressly waive any right to initiate or transfer proceedings to any other jurisdiction, forum, or venue, to the fullest extent permitted by law.
